IMPORTANT NOTICE REGARDING INSURANCE AND LIABILITY

RIDEHOME IS A TECHNOLOGY PLATFORM ONLY. WE DO NOT PROVIDE ANY MOTOR INSURANCE COVERAGE. BY USING THESE SERVICES, CUSTOMERS (VEHICLE OWNERS) EXPRESSLY ACKNOWLEDGE THAT MOST PERSONAL MOTOR INSURANCE POLICIES IN SINGAPORE EXCLUDE COVERAGE FOR "HIRE OR REWARD" PURPOSES. THE USE OF A PAID DESIGNATED DRIVER MAY RENDER YOUR INSURANCE POLICY VOID. YOU VOLUNTARILY ASSUME ALL RISKS OF PROPERTY DAMAGE, PERSONAL INJURY, OR THIRD-PARTY CLAIMS ARISING FROM THE VOIDING OF YOUR INSURANCE. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. READ IT CAREFULLY.

These Terms and Conditions ("Terms" or "Agreement") constitute a legally binding agreement between you ("User", "Member", "Customer", or "Driver") and RideHome ("RideHome", "we", "us", or "our"), governing your access to and use of the RideHome mobile application, website, and related services (collectively, the "Platform").

By creating an account or using the RideHome Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. SCOPE OF SERVICES

1.1 Platform Role

RideHome is an online marketplace and intermediary that enables registered users ("Members") to connect with independent third-party providers of designated driving services ("Drivers" and the services they offer are "Driver Services"). The RideHome Platform includes our website, mobile applications, and any associated services (collectively, "RideHome Services").

1.2 No Transportation Services

RideHome is NOT a transportation service provider, an operator of point-to-point services under the Point-to-Point Transport Industry Act 2019, or a freight forwarder. We do not own, operate, or control any vehicles. We do not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any Driver Services.

1.3 Direct Contract Between Members

When Members make or accept a booking, they are entering into a contract directly with each other. RideHome is not and does not become a party to or other participant in any contractual relationship between Members. Drivers alone are responsible for their Driver Services.

1.4 No Agency

No joint venture, partnership, employment, or agency relationship exists between RideHome and any Member.

2. ELIGIBILITY AND ACCOUNT SECURITY

2.1 User Eligibility

You must be at least 18 years old and able to enter into legally binding contracts to access and use the RideHome Platform or register a RideHome Account. By accessing or using the RideHome Platform, you represent and warrant that you are 18 or older and have the legal capacity and authority to enter into a contract.

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials. You are fully responsible for all activities that occur under your Account. You agree to notify RideHome immediately of any unauthorized use of your Account. RideHome shall not be liable for any losses arising from unauthorized use of your Account prior to your notification to us.

2.3 Driver Verification

If you choose to use the RideHome Platform as a Driver, you must provide valid documentation including:

  • A valid Singapore Class 3/3A/3CA driving license

  • Proof of clean driving record (no major violations)

  • Any other documentation required by the Land Transport Authority (LTA) or other relevant authorities

3. DRIVER STATUS AND RELATIONSHIP

3.1 Independent Contractor Status

If you use the RideHome Platform as a Driver, your relationship with RideHome is strictly that of an independent, third-party contractor, and not an employee, agent, joint venturer, or partner of RideHome for any reason. You act exclusively on your own behalf and for your own benefit, and not on behalf of RideHome.

3.2 No Control

RideHome does not direct, control, or supervise the manner in which you perform the Driver Services. You retain sole discretion over:

  • When, where, and for how long you provide Driver Services

  • Your working methods and routes (subject to road traffic laws)

  • Whether to accept or decline any booking

  • Whether to use other applications or provide services independently

3.3 No Benefits

Drivers are not entitled to Central Provident Fund (CPF) contributions, paid leave, medical benefits, work injury compensation, or any other benefits from RideHome.

3.4 Personal Equipment

Drivers must provide and maintain their own transportation equipment (e.g., electric scooters, bicycles) to travel to/from pickup locations at their own cost.

4. CUSTOMER OBLIGATIONS AND ACKNOWLEDGEMENTS

4.1 Vehicle Safety and Insurance

As a Customer, you represent and warrant that:

  • Your vehicle is in safe operating condition and validly registered

  • Your vehicle has a valid certificate of insurance (COE) as required by Singapore law

  • You have verified with your insurer whether your policy provides coverage when the vehicle is driven by a third-party designated driver

YOU ACKNOWLEDGE THAT MANY PERSONAL MOTOR POLICIES EXCLUDE COVERAGE FOR PAID DRIVERS. RIDEHOME DOES NOT PROVIDE ANY INSURANCE COVERAGE WHATSOEVER FOR THE VEHICLE, ITS OCCUPANTS, OR ANY THIRD PARTY.

In the event of any accident, loss, or damage, you agree to look solely to your own insurer (or the Driver's personal insurer, if any) for recovery, and you waive any claim against RideHome.

4.2 Pre-Trip Vehicle Inspection

You acknowledge that Drivers may take timestamped and geo-tagged photographs of the vehicle's exterior and interior prior to commencing the trip for the purpose of documenting its pre-existing condition. By proceeding with the trip, you confirm the accuracy of such documentation. In the event of a damage dispute, RideHome reserves the right to rely on such photographic evidence to determine liability.

4.3 Post-Trip Inspection

Drivers may similarly take photographs upon completion of the trip to document the vehicle's condition. Such photographs shall constitute primary evidence in any dispute regarding damage allegedly caused during the trip.

4.4 Prohibited Items (Singapore Strict Compliance)

You agree not to carry or transport any illegal, hazardous, or explosive materials in the vehicle. Prohibited items include but are not limited to:

  • (a) Controlled drugs or substances under the Misuse of Drugs Act (Chapter 185)

  • (b) E-vaporisers (vapes), vaporiser liquids, or any related components, regardless of nicotine content

  • (c) Weapons, hazardous materials, or any items prohibited by Singapore law from being transported in a vehicle

  • (d) Stolen goods or items of suspicious origin

4.5 Conduct

You agree to treat the Driver with respect. No verbal or physical abuse, harassment, or threatening behavior will be tolerated. You agree not to ask the Driver to violate any traffic laws (e.g., speeding, running red lights, illegal parking).

4.6 Intoxicated Passengers

If you are, in the Driver's reasonable opinion, intoxicated to the extent that you are unable to provide clear directions, pose a safety risk to yourself or others, or are likely to cause damage to the vehicle, the Driver reserves the right to refuse or terminate the ride. This right is exercisable unless you are accompanied by a sober adult who can assume responsibility.

4.7 Cleaning Fee

If you or any person accompanying you soils the vehicle (including but not limited to vomiting, spillage, or other mess), you agree to pay a non-negotiable cleaning fee of SGD 150 (or such amount as displayed in the App) directly to the Driver or via the Platform. This fee may be increased based on the actual cost of professional cleaning required.

5. DRIVER OBLIGATIONS AND COMPLIANCE

5.1 Professionalism

Drivers agree to provide the service in a professional, safe, and courteous manner.

5.2 Compliance with Laws

Drivers shall obey all traffic laws and regulations at all times. Drivers confirm that their provision of Driver Services complies with all directives, codes of practice, and licensing requirements (if any) issued by the Land Transport Authority (LTA) or other relevant authorities. It is the Driver's sole responsibility to ensure their activities are lawful under the Road Traffic Act (Chapter 276) and other applicable laws.

5.3 Licensing

Drivers must maintain a valid Singapore Class 3/3A/3CA driving license and ensure they are not disqualified from driving or subject to any suspension.

5.4 Insurance and Financial Responsibility

Drivers represent and warrant that:

  • (a) They maintain, at their own expense, valid public liability insurance or any other insurance required by law to lawfully provide paid designated driving services in Singapore

  • (b) They understand that RideHome does not provide them with any insurance coverage for accidents, injuries, or property damage arising from the Driver Services

  • (c) They agree to indemnify and hold RideHome harmless from any claims arising from their failure to maintain adequate insurance or their inability to pay for damages they cause

5.5 Driver's Equipment

Drivers are solely responsible for the security, safety, and storage of their personal transportation equipment (e.g., electric scooters, bicycles). RideHome is not liable for any loss, theft, or damage to such equipment.

  • Storage in Customer's Vehicle: If the Driver's equipment is stored in the Customer's vehicle during the trip, it is stored at the Driver's own risk

  • Liability for Damage: Drivers agree to indemnify Customers for any physical damage caused to the Customer's vehicle by the Driver's equipment during the loading, unloading, or transportation thereof

5.6 Criminal Record

Drivers represent that they have no criminal convictions that would disqualify them from providing transportation services or that would pose a safety risk to Customers.

6. PAYMENTS, FEES, AND DISPUTES

6.1 Payment Processing

Payments are facilitated through third-party payment processors. RideHome does not store full credit card details and is not responsible for errors or delays caused by the payment gateway. By using the Platform, you authorize RideHome to charge your selected payment method for all fees incurred.

6.2 Fare Structure

Fares are calculated based on the Platform's algorithm (including distance, time, and demand factors) but remain a transaction between the Customer and Driver. The final fare displayed at the time of booking is an estimate; the actual fare may vary based on the completed trip.

6.3 Trip Modification and Waiting Time

If a Customer requests a change to the destination or requests additional stops during the trip, the fare may be recalculated based on the actual distance and time traveled. Drivers are entitled to charge a waiting fee (as specified in the App) if the Customer requires the Driver to wait beyond a reasonable grace period (typically 5 minutes) at any point during the trip.

6.4 Cancellations and No-Show

  • Customers may cancel a booking at any time prior to the Driver's departure to the pickup location without charge

  • If a cancellation occurs after the Driver has departed to the pickup location, a cancellation fee (as displayed in the App) may be charged to compensate the Driver for time and travel

  • If the Customer is not present at the pickup location within a reasonable waiting time (as specified in the App) after the Driver's arrival, a no-show fee may apply

6.5 Taxes

Drivers are solely responsible for determining their applicable tax obligations and filing their own taxes with the Inland Revenue Authority of Singapore (IRAS). RideHome does not withhold taxes unless required by law.

6.6 Platform Mediation Power

RideHome reserves the right, but not the obligation, to mediate disputes between Members. Based on available evidence (including GPS data, timestamps, photographs, and in-app communications), RideHome may, in its sole discretion:

  • Determine the outcome of a dispute

  • Withhold, reverse, or adjust payments

  • Issue credits or refunds

  • Suspend or terminate accounts

Such decisions are final and binding for the purpose of platform settlement, without prejudice to the parties' rights to pursue formal legal action in the appropriate Singapore forum.

7. PROHIBITED ACTIVITIES

You are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the RideHome Platform. In connection with your use of the RideHome Platform, you will not and will not assist or enable others to:

  • (a) Breach or circumvent any applicable laws or regulations, agreements with third parties, third-party rights, or these Terms

  • (b) Use the RideHome Platform for any commercial or other purposes that are not expressly permitted by these Terms

  • (c) Copy, store, or otherwise access or use any information, including personally identifiable information about any other Member, contained on the RideHome Platform in any way that is inconsistent with RideHome's Privacy Policy or these Terms

  • (d) Discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation

  • (e) Possess, consume, or transport any illegal drugs or controlled substances in violation of the Misuse of Drugs Act (Chapter 185)

  • (f) Possess or use e-vaporisers (vapes) or any related items, regardless of nicotine content

  • (g) Engage in any form of stalking, threats of violence, or intimidating conduct

  • (h) Tamper with or disable the GPS tracking or safety features of the RideHome Application

  • (i) Create multiple accounts for the purpose of abusing promotions, referrals, or incentives

  • (j) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity

8. TERM AND TERMINATION

8.1 Agreement Term

This Agreement shall be effective for a 30-day term, at the end of which it will automatically and continuously renew for subsequent 30-day terms until such time when you or RideHome terminate the Agreement.

8.2 Termination by RideHome

RideHome may terminate this Agreement for convenience at any time by giving you 30 days' notice via email or by removing your access to the Platform.

RideHome may immediately, without notice, terminate this Agreement or suspend your account if:

  • (i) You have materially breached your obligations under these Terms

  • (ii) You have violated applicable laws, regulations, or third-party rights

  • (iii) RideHome believes in good faith that such action is reasonably necessary to protect the personal safety or property of RideHome, its Members, or third parties

  • (iv) You have engaged in fraudulent, abusive, or illegal activity

8.3 Termination by User

You may terminate this Agreement at any time by deleting your account and ceasing use of the Platform.

8.4 Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

9. FORCE MAJEURE

Neither party shall be liable for any failure or delay in performing their obligations under these Terms (excluding payment obligations) where such failure or delay results from any cause beyond that party's reasonable control. Such causes include but are not limited to:

  • Acts of God (including monsoon floods, earthquakes, fires, explosions)

  • Government actions, orders, or restrictions (including "circuit breaker" measures, lockdowns)

  • War, terrorism, civil unrest, or riots

  • Pandemics, epidemics, or public health emergencies

  • Failure of public or private telecommunications networks

  • Power outages or grid failures

  • Strikes or labor disputes

The affected party shall notify the other party promptly and use reasonable efforts to mitigate the impact of the force majeure event.

10. DISCLAIMERS

10.1 "As Is" Basis

If you choose to use the RideHome Platform, you do so voluntarily and at your sole risk. The RideHome Platform is provided "as is" and "as available," without warranty of any kind, either express or implied.

10.2 No Warranties

To the maximum extent permitted by law, RideHome disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

  • Warranties that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components

10.3 No Endorsement

RideHome does not endorse any Driver, Customer, or Listing. RideHome explicitly disclaims all liability for any act or omission of any Driver, Customer, or other third party. RideHome does not guarantee the performance, conduct, or suitability of any Driver or Customer.

10.4 Insurance Disclaimer

Without limiting the foregoing, RideHome expressly disclaims any responsibility for, and you assume full responsibility for, all risks related to the lack of insurance coverage, including but not limited to any personal injury, property damage, or financial loss arising out of or in connection with any Driver Services.

11. LIMITATION OF LIABILITY

11.1 Exclusion of Damages

To the maximum extent permitted by the Unfair Contract Terms Act 1977 and other applicable laws, neither RideHome nor any other party involved in creating, producing, or delivering the RideHome Platform will be liable for any:

  • Incidental, special, exemplary, or consequential damages

  • Lost profits, loss of data, or loss of goodwill

  • Service interruption, computer damage, or system failure

  • Cost of substitute products or services

  • Damages for personal or bodily injury or emotional distress

11.2 Insurance-Specific Limitation

This limitation applies including but not limited to any damages resulting from the lack of insurance coverage provided by RideHome. You expressly waive any right to claim that RideHome should have maintained insurance for your benefit.

11.3 Cap on Liability

In any event, RideHome's total liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the total service fees paid by you to RideHome in the six (6) months preceding the claim, or SGD 100 if no fees were paid.

11.4 No Exclusion for Negligence Causing Death or Injury

Nothing in these Terms limits or excludes RideHome's liability for death or personal injury caused by its own proven negligence, or for fraud or fraudulent misrepresentation.

12. INDEMNIFICATION

You agree to release, defend (at RideHome's option), indemnify, and hold harmless RideHome and its affiliates, subsidiaries, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

  • (i) Your breach of these Terms or our Policies or Standards

  • (ii) Your improper use of the RideHome Platform or any RideHome Services

  • (iii) Your interaction with any Member, including without limitation any injuries, losses, or damages (whether compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of such interaction

  • (iv) Your breach of any laws, regulations, or third-party rights

  • (v) Any accident, loss, or damage occurring during a trip, specifically where insurance coverage is denied

This indemnity applies regardless of whether such losses are covered by insurance. You agree that you are personally responsible for these costs.

13. PROMOTIONS AND COUPONS

13.1 Usage

From time to time, RideHome may offer promotions, coupons, referral codes, or discounts ("Promotions"). Unless otherwise stated:

  • Promotions are non-transferable, non-refundable, and cannot be exchanged for cash

  • Promotions are valid only for the specified period and expire thereafter

  • Promotions cannot be combined with other offers unless expressly permitted

13.2 Abuse

RideHome reserves the right to void any Promotion or suspend any account if it detects:

  • "Promo-farming" or creation of duplicate accounts

  • Fraudulent use of referral codes

  • Any attempt to manipulate or abuse the Promotion system

13.3 Modification

RideHome may modify, suspend, or terminate any Promotion at any time without prior notice.

14. DATA PROTECTION AND PRIVACY

14.1 Consent (PDPA)

By using the RideHome Platform, you consent to the collection, use, and disclosure of your personal data (including real-time GPS location, identification documents, and trip history) as described in our Privacy Policy, which complies with the Personal Data Protection Act 2012 (PDPA).

14.2 Purpose of Collection

Your data is collected for the purposes of:

  • Facilitating bookings and connecting you with Drivers

  • Verifying identity and eligibility

  • Ensuring safety and security (including GPS tracking)

  • Processing payments

  • Improving our services

14.3 Marketing Communications

Unless you opt-out via the App settings or by contacting us, you consent to receive administrative and promotional messages (including SMS, email, and push notifications) from RideHome. This serves as your "clear and unambiguous consent" under the Do Not Call (DNC) provisions of the PDPA.

14.4 Withdrawal of Consent

You may withdraw consent subject to contractual and legal restrictions. However, withdrawal may limit or prevent your use of certain Platform features.

15. GENERAL PROVISIONS

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and RideHome regarding your use of the Platform, superseding all prior or contemporaneous agreements, understandings, or representations (whether written or oral).

15.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction in Singapore, such provision shall be struck or modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

15.3 Waiver

No failure or delay by RideHome in exercising any right or remedy shall operate as a waiver thereof. Any waiver must be in writing and signed by an authorized representative of RideHome.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without RideHome's prior written consent. RideHome may assign these Terms without restriction (including to an affiliate or successor in the event of a merger or acquisition).

15.5 Notices

Any notices to RideHome shall be sent to the contact email address provided in Section 17. RideHome may provide notices to you via email, push notification, SMS, or by posting on the Platform.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the Republic of Singapore.

16.2 Dispute Resolution Process

  • Step 1 - Negotiation: Parties shall first attempt to resolve any dispute through amicable negotiation and internal complaint processes available on the Platform

  • Step 2 - Small Claims Tribunals: If you are a Customer acting for purposes outside your trade, business, or profession, and the claim amount is within the jurisdictional limits (currently up to SGD 20,000, or up to SGD 30,000 by agreement), you may choose to bring a claim in the Small Claims Tribunals (SCT) of Singapore

  • Step 3 - Courts of Singapore: For all other disputes, including those exceeding the SCT jurisdiction or involving Drivers acting in a business capacity, the parties submit to the exclusive jurisdiction of the Courts of Singapore

16.3 Injunctive Relief

Nothing in this dispute resolution clause shall prevent RideHome from seeking injunctive relief or pursuing any other remedy in any court having jurisdiction over matters arising from any alleged or actual breach of security, intellectual property rights, or confidentiality.
